Attorney Jackson Hilliard has lived in St. Petersburg and the Tampa Bay area for the past ten years. Mr. Hilliard received his Bachelor’s degree in 1988 from the University of Central Florida. He earned his law degree in 2006 from Stetson College of Law. He is a member of multiple associations, including the Florida Bar, Clearwater Bar, St. Petersburg Bar, the National Association of Criminal Defense Lawyers, and the Florida Association of Criminal Defense Lawyer. Believe it or not, you can get a DUI even if you are not driving. The government can prosecute you under a theory of actual physical control. In other words, the government can argue that even though you were not driving your car, you were in actual physical control when you were stopped. 
		
	However, in order to prove the person behind the wheel was in actual physical control, the governement has to prove that the person behind the wheel could have easily started the car. For instance, if the car has a dead battery, the driver is not in actual physical control.  And the government must prove that the ignition key was readily accessible.  If there is no key on the sleeping individual behind the wheel, then he arguably does not have actual physical control.
