- Q. Help with boyfriend on probation hold due to false report.
- A: On a probation hold, the officer would have to file a motion to revoke probation within 5 days, and then he would be see by the court within 2 days of the motion being filed. Once he's seen by the court, the Judge can either set a bail or hold him to a final hearing on whether he violated probation or not. The best step he can take at this time is to obtain a lawyer to represent him. If he can't afford to hire a lawyer, the court will appoint one at his initial appearance.
- Q. Do I have to submit to a breathalyzer at a DUI checkpoint?
- A: Law enforcement needs probable cause to believe you are impaired in order to ask you to submit to a breath test. Portable breath test results are not admissible in Maine to establish a breath alcohol measurement. Only Intoxilyzer test results from a properly conducted test, and State approved machine, can be admitted in Court as evidence of a breath alcohol measurement.
- Q. How to correct errors in my criminal history report for current Maine charges?
- A: You will want to obtain a certified copy of the judgements in the prior cases. The certified copies are the official record of what occurred in the prior cases. Your lawyer can request these from the Court.
