- A: The answer is never a simple yes or no as to whether you will go to jail as a first time offender. Everything depends on the facts of the case and the charges. Please know that charges can be upgraded as well as downgraded until you go to trial. Programs do exist that the prosecutor may agree to, which would keep you out of jail and on probation as a first time offender, the problem is with this charge generally the prosecutor will deny a defendant entry into those programs for example PTI due to the nature of the charge and defendants actions.
