Q. I bought a used car off of craig's list that turned out to be a disaster -- do lemon laws still apply?
A: Wisconsin's lemon law does not apply to the purchase of used car. However, Wisconsin does have remedies available to consumers that buy used cars based on affirmative misrepresentations by the seller, both private parties and car dealers. There may also be warranty claims if you purchased a warranty or service contract. You may want to consult with an attorney licensed in Wisconsin and familiar with the consumer protection laws to see what your rights are.
Q. I'm worried about buying a lemon -- what tips do you have for buying used cars in Wisconsin?
A: Buying a used car can be scary, especially if you are not familiar with signs of prior accident damage and repair and mechanical issues. A: Your rights in Wisconsin against the seller of a used car depend on whether you bought from a dealer or a private party, what affirmative representations were made about the car, and the terms of the agreement you entered. There're too few things known about your purchase circumstances to be able to give you any opinion on your remedies at this point. I recommend that you consider contacting an attorney licensed is in Wisconsin that practices consumer protection for a consultation to obtain an opinion on what you may be able to do. Generally speaking, if any seller made intentional misrepresentations, you will have remedies. If a dealer made misrepresentations of fact, even if they were not intentional, you will have remedies.
