Q. I don’t know if I have anything here. But thought I would ask. Better to ask then always wonder and wish I'd of asked.
A: I agree with both of my colleagues answer. In order to establish a case for negligence against the vendor of an expired drug, you would have to be able to establish that there was a causal link between the medication and the harm caused to your child. Only a doctor can tell you if the pneumonia may have been caused by an expired medication, however, that sounds unlikely. Until you can establish that link, you cannot establish a viable case for negligence, resulting in damages. I hope your child recovers quickly without any further consequence.

A: I am sorry to hear about your injury. It does sound like you have a potentially viable claim against the owner of the property. A fan should not fall, typically without negligence of some kind. In fact, there is a legal doctrine called "Res Ipsa Loquitur", essentially means the thing speaks for itself. Your symptoms sound like you may be suffering from a concussion and post concussion syndrome type injuries. You will need a good neurologist to diagnose the condition. If you have nausea, vomiting, blurry vision, double vision, floaters, white spots in your vision field hearing, change light sensitivity, headaches and overtime notice memory personality and her concentration problems you very well may have a mild traumatic brain injury. Not all doctors or diagnostic facilities are trained to diagnose these. Lawyers with experience and recognize the symptoms where even emergency rooms and less experienced doctors could miss it. You should consult with a local lawyer immediately. I will be happy to speak to you and advise you of your rights and direct you to the proper medical care in order to determine whether you have serious injuries causally related to this accident.
Q. Product bought that leaked chemicals that caused sever burns and scarring.
A: You haven't asked a question. I assume the question is, do you have a viable case? In order to determine whether you have a viable case, you will need to speak to a qualified product liability lawyer in your area. However, any lawyer will want you to save the package, medically document the injury (i.e., make an appointment with your primary care doctor and/or a dermatologist or other doctor qualified to treat whatever the medical condition is) and take photographs until you get to the lawyer and or Dr. to show the development of the wound. You should also keep any purchase receipts as anybody in the retail chain may be liable, including the seller. If the product is defective and where the packaging failed through negligence, you may have a viable claim.
Q. Defendant's lawyers claim attorney client privilege, and defendant sparsely answers interrogatories?
A: If you have a lawyer that is a question you should ask your lawyer. However, it is common for lawyers, especially those representing insurance companies to object to most every question asked. It is how many lawyers "litigate". Most jurisdictions require a good-faith conference before filing a motion to compel better answers or overrule objections. The only way to beat this tactic is to take in front of the judge and prove that the answers or objections failed to answer the substance of the question and at times even can be sanctioned. If you're representing yourself. You should hire your own lawyer as you are not equipped to conduct this battle. They know that and will continue to file frivolous objections until properly challenged and if necessary sanctioned by a judge.
Q. A Ca police officer sees a suspected murderer while both are on board a cruise ship bound from SD to Hawaii.
A: Not easily. thi8s is not a Maritme law issue and probably not one of criminal jurisdiction. What would the arresting officer do with the arrestee? Without at least the Ship's Captain and Chief Security Officer involved, the "arresting" officer could be liable for civil damages for false arrest, imprisonment, abuse of process, etc. The Ships Captain has the ultimate authority on the ship to decide whether to intervene, and from my experience in dealing with the cruise lines regularly for over 25 years I doubt they would intervene. The Federal Cruise Vessel Safety and Security Act may have some language that controls but it really involves crimes rpaes.etc on the ship, not suspected criminals who happen to be on the ship, and even that act has no teeth.
Q. Can my daughter's father hire a lawyer for an accident our minor daughter was in w/o my consent?
A: Yes, however the better question is do I have a right to claim damages suffered by your daughter. While you do also have rights, the ultimate issue will be who controls (supervises) the money until your daughter turns 18. If the case is not yet in suit, you can hire a lawyer to advise the responsible party/insurance company of the wrongdoer(tortfeasor), and make them aware of your interest in the outcome, and, moreover that you are the primary residential parent, who presumably has the majority of the expenses day to day interaction with your child. What if anything does your Fina judgement/Marital settlement Agreement say regarding this situation? I suspect it requires joint decision making, as its a matter of shared parental responsibility. id be wary of the ex spouse trying to grab the settlement funds for his personal use, as any settlement over $15,000 net to your daughter must be court approved. Let the lawyer who he hired know of your interest in seeing to a fair outcome, and that you expect the money to be court approved and supervised. if there is enough money involved id' hire a lawyer (who will work on a contingency basis) and if a relatively small amount contact the attorney on the case now and discuss your rights, then depending upon the answer proceed from there.
