In order to establish a case for negligence against the vendor of an expired drug, you would have to be able to establish that there was a causal link between the medication and the harm caused to your child. In order to determine whether you have a viable case, you will need to speak to a qualified product liability lawyer in your area. However, any lawyer will want you to save the package, medically document the injury (i.e., make an appointment with your primary care doctor and/or a dermatologist or other doctor qualified to treat whatever the medical condition is) and take photographs until you get to the lawyer and or Dr. to show the development of the wound. You should also keep any purchase receipts as anybody in the retail chain may be liable, including the seller. If the product is defective and where ... Read More
