Q. I want to find a lawyer for my divorce and pay when we win. Is it possible? How to find this lawyer if possible?
A: Unlike personal injury cases, family lawyers are not permitted by Rules Regulating the Florida Bar from accepting domestic relations cases on a contingency basis. Nonetheless there are other avenues to consider when you are trying to resolve a family law matter and have limited funds to do so. Here are some alternatives: You can contact a law office and request an office consultation to understand the issues which your case involves. Sometimes a 30 or 60 minute consultation will be especially helpful at the beginning of your case in order to frame the actual case itself. The help you receive at the beginning of a case is often most valuable. Many experienced lawyers will offer a paid consultation which include reviewing the legal process with you (i.e. when an answer or response is due, what documents to file; when financial discovery is to be exchanged and what must be included by both parties; how to decide on a family law mediator; and a discussion of the issues of the legal issues which you are facing). Even if you cannot hire a lawyer for the full case, an initial legal review can help you spot legal issues and how they may be resolved. If you are in a community which offers legal clinics, there are some in Miami-Dade County and in St. Lucie County. If you self represent, there are state resources which furnish and explain legal forms approved by the Supreme Court of Florida. While Clerk of Court and Judicial Assistants cannot and do not provide legal advice, some jurisdictions in Florida have pro se coordinators who assist the judges in scheduling hearings and trials. If you are served legal papers, do not let your case do into default where you may lose your legal rights. ... Read More
