6 Questions Answered

Q. What is the statute of limitations for a work accident in South Carolina?
A: While there are exceptions to the rule the statute of limitations is 2 years from the date of your work accident.
Q. I got hurt at work in dec 28th 2010 and workmans comp is not paying me yet what do i do ?
A: You should either file with your local Commission or have an attorney in your area assit you in doing so. If the insurance company/employer will not voluntarily do what they are supposed to do by law, then you have to move before your Commission seeking an Order making them.
Q. What is the notice deadline for reporting an accident in South Carolina?
A: While there are exceptions to the rule, 90 days from that date of the accident.
Q. Got injured at work and fractured left elbow and I am now 3% disabled in elbow. Workers comp wants togive me a settlemet
A: First, the 3% you were given by your doctor is likely impairment (which is a medical determination) and not disability (which is a legal determination). Your disability is likely greater than your impairment. If your doctor is recommending future medical treatment you usually should not settle this out and should negotiate to keep said medical treatment open and on going.
Q. Does workmens comp cover me on my break?
A: Each state WC system is different so you need to contact an attorney in your area. The initial consultation is usually free and make sure you establish this up front. In many states like South Carolina where I practice, you are covered on your break as long as there is no "substantial deviation from your employment" while on your break. Again, each state has different laws on this so make sure you consult an attorney in your area.
Q. What happens if you can not afford a lawyer and you are being sued in a civil lawsuit
A: There may be a pro-bono (free legal services) program that can help you depending on what type of civil suit you have against you. You should contact the South Carolina Bar @ 800 868 2284 to obtin a list of all current pro-bono programs available. Best of luck.
