Q. Are hold harmless agreements enough for a workers' comp audit in NJ?
A: New Jersey looks at several factors to determine whether someone is truly an independent contractor. Using their own equipment and working for other clients helps your case, but the audit will still require documentation. That’s why the carrier is asking for each contractor’s workers' comp status.

If a videographer is a sole proprietor or single-member LLC with no employees, they may be exempt from carrying coverage, but it’s still smart to get a certificate of insurance showing that status or a written declaration confirming their exemption.
Q. Can I be sued for a truthful social media post about crimes?
A: Legally, if what you posted is factually accurate and can be proven true, it likely isn’t defamation. Truth is a complete defense. That said, just because someone can file a lawsuit doesn’t mean it has merit. People can threaten legal action for many reasons, including embarrassment or retaliation. Still, it’s smart to be cautious with how information is shared publicly. If you’re unsure whether your post crossed a legal line, speaking with an attorney is a good next step to protect yourself.
Q. Workers' comp light duty, no tasks available, should I be paid?
A: If you’ve been cleared for light duty and your employer doesn’t have any work available, you may still be entitled to workers’ compensation benefits for the days you’re not working. I’ve seen this situation before. Just because you’re cleared for light duty doesn’t mean your employer can leave you without pay if they can’t offer a job within your restrictions. You should not be penalized because they have no tasks available. It’s a good idea to speak with a workers’ comp attorney who can make sure your rights are protected and that you’re getting the benefits you deserve.
