- Q. When there is a civil issue regarding an issue where multiple states are involved, where do I go to get a lawyer?
- A: You should hire a lawyer in the state where the charges are pending. It may be possible to hire a lawyer from another state, but you are best off with a local lawyer familiar with the state's rules where the charges are pending. Hire a lawyer licensed to practice in the state where the ethics board is located.
- Q. When will my deadline start for me to file a legal malpractice lawsuit against a former lawyer?
- A: Hi, your question comes up very often. The first to do is to focus on winning the post-conviction petition. Many states have a rule that the plaintiff (former prisoner) has to establish actual innocence before filing a lawsuit. So, I would focus on that requirement before worrying about a malpractice case. In Illinois, once you were found innocent you would have two years to file a case against the lawyer for malpractice.
- Q. I had a mild heart attack brought on by a proposed eviction supported the succession attorney hired by sister. recourse?
- A: I am sorry you had a heart attack, but the heart attack was not caused by the eviction or the attorney so, no, you can't sue them.
