Biography

Rudy Taylor is a past Assistant District Attorney and a Special Prosecutor. He has practiced only Criminal Law since 2006 and has over 30 Jury Trials to his credit. He is experienced in all areas of criminal law from Capital Murder/Death Penalty to Simple Assault, Meth to Marijuana, Sex Crimes, and everything in between. He has recently began representing the Director of Morale @StoolFrederic in the Chicago Cubs @cubs baseball organization in Trademark matters.

Q. My sister is currently incarcerated, she was put with a enemy while shackled. And injured what kind lawyer could help?
A: This sort of negligence on the part of the county is a personal injury case requiring expertise in that area.

There is a possible case there but it may be difficult to come find a lawyer willing to do it on contingency fee alone because it has obvious problems. A jury isn't going to be as sympathetic to an inmate as they would her grandmother who got hit by a speeding car full of drugged up teenagers while she was walking to Sunday school class. And these days most all liability for governmental entities is capped so that even the best award of damages is not enough to pay expenses.

Q. I had agg.asslt w/deadly wpn chrg against my spouse. Case dismissed. How does she get her firearm back?
A: File a Motion to Return Property with the clerk of the same court the case was dismissed asking to be heard regarding the gun. The Motion requesting return of the gun. Here's one that I drafted. Serve the DA with a copy and speak to someone in her office about agreeing to return it. They may still want you to file the motion for paper trial reasons.
Q. I was arrested for Artical 17.292(a) I was ordered to stay 500’ from my fiancé home or place of employment for 61 days
A: First, an emergency protection order may be issued against someone arrested for a violation like you described. You didn't mention an arrest but I will assume you were. Further, I will assume that you were arrested for a violation that falls under the statute you cited. It all sounds legal for a magistrate to do. So, next what can be done.

You should hire a lawyer and remove the temporary protective order to the court that is handling your penal code violation and motion that court to amend the order because it isn't workable. It isn't an easy endeavour. Your lawyer would have to show the court that the alleged victim is in no danger if are allowed at her job or home and why the order is unworkable.

You should not contact the alleged victim in any way, including but not limited to, by phone, in person, within eyesight, through a mutual aquantence or family member, by mail or by carrier pigeon. Your order may not state any of those things specifically but it is implied. Just don't.

If you have an appointed lawyer, ask him to bring the order over to the court that you have been assigned. The magistrate is sometimes the same judge who will handle your underlying case. That may not be something an appointed lawyer has a duty to undertake; especially if the facts surrounding this are bad enough that in her professional opinion it would be a waste of the court's time to file a motion to amend the order.
