66 Questions Answered
- Q. Seeking advice on father's custody violations and child support refusal
- A: Timesharing violations and unpaid child support can be addressed by filing a motion for contempt/enforcement. Courts may impose sanctions or modify parenting plans if it serves the child's best interests. Ongoing violations may also constitute a substantial change in circumstances, supporting a modification of timesharing and child support. I recommend that you consult with an attorney to determine the best course of action.
- Q. Do I need a quit claim deed from my ex to sell property allocated to me in divorce?
- A: In Florida, the Final Judgment typically specifies the timeframe within which the parties must execute quit claim deeds and similar actions. However, if your Final Judgment is silent on that matter, you may reach out to your former spouse and request that they execute the quit claim deed before selling the property.
- Q. Timeline for completing course after signing Paternity Acknowledgment in Florida
- A: In Florida, the Respondent must complete the course within 45 days after acknowledgment of paternity by that party, adjudication of paternity of that party, or an order granting time-sharing to or support from that party, unless excused by the court for good cause. If the Respondent did not take the course within the 45-day timeframe, they can still complete the course during the case.
