When I was badly hurt in a car accident, I decided that someday, I would start my own practice so I could help people struggling with injuries.

Deena Buchanan is Board Certified in Truck Accident Law by the National Board of Trial Advocacy and is known nationwide for her representation of plaintiffs in trucking, wrongful death, and employment discrimination cases. After years of defending Fortune 500 companies in high-stakes trucking, medical malpractice and employment cases, she switched gears in 2019 to champion victims of corporate negligence by founding her own firm.
A passionate advocate and industry leader, Deena serves on the Board of Regents for the Academy of Truck Accident Attorneys (ATAA) and co-chairs its 2024-2025 Education Committee. She's also very involved with the American Association for Justice (AAJ), serving on the Executive Board of the AAJ Trucking Litigation Group, co-chairing the TLG Education Committee for 2024-2025, and actively participating in the Diversity, Equity, and Inclusion Committee of the AAJ Traumatic Brain Injury Litigation Group.

- Q. Seeking legal advice on workplace harassment and violence in New Mexico.
- A: I strongly recommend reaching out to a New Mexico employment lawyer right away. This is a dangerous situation and you should not have to suffer this type of abuse at work. You can also seek a protection from abuse order from your local court. They do apply to workplace abusers.
- Q. How to resolve issue with forged engineering stamps on building plans?
- A: This sounds like a potential fraud and/or negligent misrepresentation claim if they made a representation that the plans would be sold with appropriate engineering stamps. You may be able to recover the cost of your investment and unravel your contract. I would contact a lawyer who focuses on representing individuals in breach of contract claims to advise you further. Depending on the terms of your contract, there may be a provision for that lawyer to recover attorney fees, but not all contracts allow that. I don't practice in that area anymore because I focus on physical injury and employment law cases now, but this does seem like something for you to pursue.
- Q. I was laid off of work while on FMLA. What can I do?
- A: This situation may trigger retaliation claims under the FMLA, the ADA, and the NM Human Rights Act. You should contact an experienced New Mexico employment lawyer to discuss the details. Most of us offer consultations or case reviews for free. There are fairly short time limits for pursuing these claims, so please contact someone soon and good luck with resolving this.
