Q. My wife and I both received an assault by contact ticket. What should we do, we got in a fight and she called the cops
A: This is certainly a difficult situation, but a local, experienced criminal defense attorney can help. A Class C ticket has a range of punishment of $0 to $500 fine. However, a Family Violence ticket for Assault by Contact can have very serious consequences for your criminal record. You want to pursue an option where this could be expunged from your record in time. Contact an attorney as soon as possible and discuss your options.
Q. If I decide to hire an attorney and get rid of my court appointed one, will I have to wait for another court date.
A: You can hire an attorney at any time. The Court can choose to keep the court date the same, or your attorney can request a new one so he or she has time to review all the evidence prior to court. The most important thing is to work with an attorney you trust has the experience and knowledge to best defend your case and then listen to their advice on how to proceed.
Q. Can you request a court date in another city? If so how?
A: Depending upon your bond restrictions, you can move. Unfortunately, it is highly unlikely your case will be transferred while pending. While it is possible to have a probation sentence transferred to your home jurisdiction, the case will be prosecuted where it originated.
