At Trice Law Group, our mission is to deliver exceptional, personalized legal services to families and businesses. We deal with business law and litigation, probate and estate planning, and healthcare law matters. Before founding Trice Law Group, David Trice honed his legal skills at several esteemed law firms in Mobile and served as in-house counsel for DocRx, Inc., a healthcare company.

David’s extensive experience working with clients of all sizes enables him to provide practical, tailored solutions. His diverse legal background offers clients a distinct advantage, allowing him to identify and address legal challenges early, ensuring the best outcomes.

A graduate of the University of Georgia and Cumberland School of Law at Samford University, David was admitted to the Alabama State Bar in 2015. Before entering private practice, he gained invaluable experience as a judicial clerk for the Circuit Court of Baldwin County, Alabama, an opportunity that greatly shaped his legal knowledge & experience.

In 2023, David was honored as a member of Mobile Bay’s 40 Under 40. He actively contributes to the legal community as a member of the Mobile and Baldwin County Bar Associations, the American Inns of Court, and the American Health Law Association. Since 2018, he has also served on the Mobile Bar mentoring committee.

Q. If I have more assets than my deceased husband, will I get nothing or do I get one third of his assets.
A: Hello, you are referring to the Alabama Elective Share Statute, Ala. Code § 43-8-70, et seq. When calculating the elective share, the value of the surviving spouse's separate estate is considered. This includes all property and assets that the surviving spouse owns independently of the deceased spouse. The inclusion of the separate estate ensures that the elective share reflects the surviving spouse's overall financial situation, preventing an excessive claim on the decedent's estate if the surviving spouse already has substantial assets.

Q. My deceased mother owes taxes from 2023, but her estate is insolvent.
A: Hello, I can say that sometimes it is necessary to probate an estate even though it is insolvent, usually when there are creditors. You should hire a probate attorney in the area where your mother lived. The attorney will need to determine whether the asset falls outside of probate or not.
