A: Dentists are licensed and regulated by the Texas Board of Dental Examiners and are held to meet the standards of care outlined in its rules and regulations. Informed Consent is a primary step before proceeding with any dental procedure. The dentist is required to provide the patient (in your case, a parent of a young child) with details about the procedures to be performed and any associated risks. Usually, the dentist will have a discussion with the patient and present an "informed consent" document for signature showing approval to perform the procedure. I would suggest that you consult with an attorney familiar with medical malpractice litigation in Texas for assistance in investigation of your claim and possible legal action that may be necessary as these cases may be complex in following Texas law. Q. I was bit in my face by a pit bull on jun1 I have a major scar on my face can I sue the dog owner
A: Generally, the recent past Texas cases would allow the Dog owner to avoid liability if he had no knowledge of his dog's propensity to bite--so the dog's first bite was a "free bite". However, a few factors would create possible negligence of the dog owner if there is evidence of proving the dog owner's knowledge of the dog's history of biting people; or other circumstances showing that the dog was threatening and not properly supervised or in his fenced yard.

Further, the dog owner's homeowner's insurance may cover your liability claim. I would suggest contacting a personal injury trial lawyer who has experience in proving the dog owner's negligence and the full extent of your damages. The lawyer may be able to negotiate a settlement of your case without the necessity of filing a lawsuit. ... Read More

A: If your complaint is against a Texas dentist, you may either file a complaint with the Texas State Board of Dental Examiners or file a dental malpractice lawsuit in a Texas District Court or both. The primary issue in any dental malpractice case is whether the dentist deviated or breached the Standard of Care as prescribed by the rules set by the State Board of Dental Examiners.

If you proceed with filing a lawsuit in Texas, you must comply with the filing requirements set by the Texas Civil Practice and Remedies Code and rules of Civil Procedure. The rules set out the necessity for an "expert opinion" that addresses the Standard of Care, the dentist's violations of the Standard of Care, damages resulting from the dentist's negligence and the causation of the damages. Generally, there is a two (2) year Statute of Limitations for filing the lawsuit.
