Q. What is the first procedures in custody case?
A: It depends on the specifics of your case, but there are a handful of initial documents that need to be drafted prior to filing the case. I'd continuing reaching out to your attorney.
Q. Can my boyfriends 17 year old choose to not come home for his scheduled visits per the divorce decree parenting plan?
A: It'll be difficult for the court to enforce that the 17-year-old should be going between each parents. However, in an ideal world, the judge would tell the parent who had custody of the child to ensure that they return to the other parent.
Q. Spouse has filed for divorce in NM, I live in MO. I recently had a stroke, any services willing to represent me?
A: You could seek to have the venue changed to Missouri, depending on your mobility and where the marriage was filed, etc. I would speak to a family law attorney near you and see if they can offer more guidance on the specifics of your case.
