Upon turning 16 and obtaining a drivers license, I obtained employment as a runner at a law office. I maintained the same employment until the end of my college days at UNLV. Gaining experience from the attorneys and familiarizing myself with the court house. The influences I received throughout that opportunity sealed the deal. After college it was straight to law school. The practice of law presents challenges on a daily bases far from the mundane 9-5. Frankly, my personality is incapable of a day to day desk job without lashing out. The constant argument with insurance adjusters and defense attorneys over liability issues and medical records, fighting for what's right, suits me well.

- Q. I have been assaulted police say there is no evidence to pursue the matter.i would like the police to help me with order
- A: The inquiry does not indicate which State you reside or where the incident took place. Given the lack of information, I am hopeful the following general information will point you in the right direction. Typically you would need to file a Motion for a Protective Order with the court. You can do this ex parte where the assailant will not have the opportunity to respond. If granted, you may have a time frame upon which you are protected and then the court will set a status (usually 30-60 days out) to see if the TPO needs to be extended for 6 months to a year. In order to have the Motion granted, the party seeking the TPO usually must demonstrate to the court that the other party physically assaulted them previously (pictures of the injuries) or that they have made threats of physical harm. Finally, you may want to look online as there are usually self-help forms available online for each jurisdiction. Hope this helps!
- Q. Got hurt at Walmart don't remember the day that happened did fill out a report and without the date do I have a case
- A: The simple answer is Yes, you still have a case. The important thing is that you filled out an incident report. Our firm has filed numerous claims against Walmart. Historically, Walmart does a fair job in preserving the evidence and getting statements from the injured party and potential witnesses. They will usually take photographs of the surrounding area where the incident took place and document physical injuries that may be observed. Finally, they will keep the incident report as this places them on notice of potential liability and triggers their duty to preserve evidence. You may want to attempt to contact Walmarts risk management department to obtain a copy of the incident report. If they will not turn the same over, you can file a lawsuit and serve a subpoena which will force their hand in turning the documents over.
- Q. The case settle and signed all documents and notarized, how long will I get my settlement payments?
- A: Typical turn around times are two - four weeks. However, there are factors which can cause delays. If medical liens exist with medicare or medicaid and your attorney is requesting reductions on the amount you are required to pay back, the same can take weeks. Further, if your claim was in litigation a voluntary dismissal of the claim will need to be filed with the courts. Finally, if there were other parties involved in the accident who were injured and not at fault, the opposing insurance company may not resolve or pay out on your claim until all of the parties have agreed to settle. To ensure your attorney is not withholding funds, ask for a copy of recent correspondence between your counsel and the insurance company or defense attorney. Has the attorney inquired as to the delay? Has your attorney already provided the opposing party with a copy of the signed release? Does your attorney have the funds in trust pending reduction requests? I strongly suggest you make a 15 minute appointment with your attorney to receive answers to these questions. Most attorneys are trustworthy and sometimes a quick meeting or phone call to catch a client up to speed on a claim will resolve any concerns. Hope this helps!
