- Q. I currently have a restraining order on the father of my 2 kids. He also plead guilty to a stalking 3rd degree felony.
- A: Thank you for your question about restraining orders. Your question is very fact specific, and more information is required in order to give a proper answer. It would also be helpful to review both the restraining order as well as the no-contact orders. There is a procedure by which you can as the court to vacate the restraining order, but in order to see if your request would be granted, a lawyer will need to review the court record. I suggest you contact a family law attorney to provide you with specific advice, especially as it relates to DCP&P.
- Q. Can a divorced husband have any rights to pensions earned after the divorce that his wife earns?
- A: Thank you for your question. Typically, assets acquired during the marriage are subject to equitable distribution and assets acquired either before the marriage or after the termination date of the marriage are not. There are, of course, circumstances in which there may be some entitlement, so I recommend that you speak with an experienced family law attorney who can review your specific circumstances and provide guidance accordingly.

If you do not have a formal court order addressing this issue specifically, then this matter will need to be addressed prior to distribution of the net proceeds at the time of sale. I suggest scheduling a meeting with an attorney to address the appropriate way to divide the net proceeds from the sale of the home as there are multiple considerations. You want to be sure you are receiving the appropriate amount at the time of sale. I strongly encourage you to address ... Read More
