Q. Does New Jersey grant a non-custodial parent to vacate child support, visitation and custody?
A: Thank you for your question. I am so sorry that you are going through this. It sounds like a really tough situation. Generally speaking, the Court will not permit a voluntary termination of parental rights unless there is good cause; avoiding a child support obligation is not something that is typically considered “good cause.” The Court can, however, modify custody such that you have sole legal and physical custody and may remove the parenting time arrangements contained in the last Order. The Court may modify the child support obligation based upon a change in circumstances, if appropriate. There are certain circumstances where that could actually be to your benefit and result in your being awarded more child support than previously. I suggest that you schedule a consultation with an attorney who can review your matter with you in more detail and provide additional guidance more specific to your particular situation.
Q. My husband wants a divorce. We are married shy of 3 yrs. Can my husband force me to leave our home?
A: Thank you for your question. If the house is in joint names, you have an equitable interest in the house, although it may not necessarily be 50% based upon the fact that he purchased it prior to the marriage and your marriage is short term. With respect to what will happen to you financially, I am unable to answer that question without more information about your Husband’s finances. If your Husband is proceeding with a divorce, I would strongly suggest that you consult with an attorney immediately to get a better idea of your rights and options. Best of luck.
Q. My boyfriend who lives in Howell Township needs help with his alimony problem so he can leave and retire
A: Thank you for your question. Unfortunately, I am not able to provide you with an answer as I do not have enough information. Whether or not your boyfriend can retire is dependent upon the terms of his Matrimonial Settlement Agreement and how long he is required to pay alimony and under what circumstances alimony can be terminated. I would strongly suggest having your boyfriend schedule a consult with an attorney to review his Agreement with him to, at the very least, offer some guidance on what his next steps should be.
