- Q. Will my future surguries be covered after car accident settlement
- A: Generally, no. Once you settle your claim with the insurance company, you forfeit your right to seek any further compensation from them related to the accident. Instead, you and your attorney must account for the cost of any expected future medical care in your initial settlement demand. The burden of proof is on you though—and the insurance company is always going to put up a fight—so you face an uphill battle which usually requires the expert witness testimony of your physicians, life care planners, healthcare economists, etc.
- Q. If someone is refusing to pay for damages they did while driving my car, can i sue? Or what would be my best option?
- A: Do you have collision insurance? As a general rule, auto insurance follows the vehicle rather than the driver. If you do have collision coverage, your best bet may be to file a claim, pay the deductible, and work out a deal (in writing) with this person to pay you back anything you had to pay out of pocket (deductible, rental car, etc). If they fail to pay you back as agreed, take them to small claims court.
- Q. Who would be at fault if someone was parked on the side of the road and opened their door as a vehicle was passing
- A: Most-likely the door opener. He or she generally has a duty to first check for approaching traffic--whether that be a vehicle or even a cyclist--if the door would open into a lane of travel.
