Anwar E. Hadeed was born and raised on the beautiful twin islands of Antigua and Barbuda in the Caribbean. The son of Syrian immigrants who moved to the islands in the 1980s, Anwar’s upbringing was shaped by the rich cultural traditions of the Caribbean and the Middle East. At 17, he moved to the United States to pursue higher education, driven by a passion for understanding human behavior and society.

Anwar graduated summa cum laude from Moravian University in Pennsylvania, earning double majors in Psychology and Sociology. As an undergraduate, he excelled in leadership roles, including President of the Psychology Club, and conducted groundbreaking research presented at national conferences. Following his graduation, Anwar achieved a lifelong dream by attending the Florida International University (FIU) College of Law, where he consistently earned a spot on the Dean’s List and actively participated in organizations such as the Caribbean Student Bar Association and International Law Students Association. During a study abroad program in Spain, he deepened his understanding of international legal systems.

While in law school, Anwar clerked at prestigious firms specializing in probate, guardianship, and estate planning, gaining invaluable experience. After passing the Florida Bar, he focused his career on these areas, helping hundreds of families navigate complex legal matters with compassion and clarity.

In 2024, Anwar established Hadeed Legal, a boutique law firm in Coral Gables, Florida. The firm offers affordable, flat-rate legal services in probate, guardianship, and estate planning. Known for his personalized approach, Anwar is committed to providing accessible and high-quality legal solutions while fostering strong client relationships.

Q. My father died 1/21. Starting 4/1-I have legal services as a benefit from my co. Can I wait until then to begin probate?
A: I'm sorry for your loss.

You're correct that Florida law requires a will to be filed with the court within 10 days of the person’s passing (Florida Statute § 732.901). However, there are no direct penalties for missing this deadline—courts typically accept late filings as long as there’s no fraudulent intent or harm caused by the delay.

Since your father had a revocable living trust with a pour-over will, most of his assets were likely placed into the trust, meaning probate may be minimal or even unnecessary. However, if any assets were left outside the trust and need to go through probate, you’ll eventually need to initiate the process.

If there’s no urgency (e.g., no creditors pressing claims, no financial hardships), you can likely wait until April to start probate when your legal benefits begin. That said, it might be wise to at least consult with an attorney now to confirm that waiting won’t create any unexpected complications.

Here’s some guidance that might help clarify your steps forward, but keep in mind that consulting a qualified probate or estate attorney in Kansas will be your best course of action. Here’s what you need to consider and act on:

Locate the Will: If your mother had a valid will, file it with the Kansas probate court to challenge your brother's claim that she died intestate (without a will).

Challenge the Petition: File an objection to your brother's petition for descent and heirship. The court needs to hear your side.

Investigate the $15,000: If your mother gave your brother the mortgage money as a gift or loan, it may reduce his share of the estate. Gather evidence (bank statements, communications, etc.).

Address the TOD Deed: If your mother intended to split the property evenly, the unfiled transfer-on-death deed may still show her intent. Consult an attorney about this.

Q. Does a person who has the Power of attorney over someone have the power to change that person will and deeds?
A: No, a person with Power of Attorney (POA) cannot change someone’s will or transfer ownership of their property deeds for their own benefit.

Here’s why:

Wills: A POA only grants authority to act on behalf of someone while they are alive. It does not give the agent the power to create, change, or revoke a will. Only the person who made the will (the principal) can modify it, as long as they are mentally competent.

Deeds: While a POA may allow the agent to manage property (e.g., sell or transfer it), the agent must act in the best interest of the principal. They cannot transfer property for personal gain unless explicitly authorized. Any misuse of POA for personal benefit could be considered fraud or breach of fiduciary duty.
