- A: Plea negotiations in DWI cases are always subject to several factors and no two cases, jurisdictions, Assistant District Attorneys or Judges are alike. In short, yes it is possible to negotiate a .15 down to a dwai conviction however, there is no guarantee, and many jurisdictions use an unspoken rule of .13 or .14 BAC as their limit for plea offers. - A: Because you were convicted of a second DWI and it was "Aggravated" within 10 years of your DWAI conviction you should have lost your driving privileges for 18 months, however, because you violated the "Zero tolerance law" for both changes, the second alcohol related charge mandated revocation of your drivers license for one year or until you turned 21 years of age whichever is longer and, depending on the Court's sentence, the 18 month suspension for the Aggravated DWI could be tacked on to begin after the one year Zero tolerance revocation was completed. - A: A NYS DWI misdemeanor conviction will result in her having a lifetime criminal record. Sentence possibilities include combinations of the following: up to one (1) year county jail time and or a fine of $500 - $1000 dollars, 3 years probation, license revocation for six (6) months, NYS surcharges of up to $400 depending on where the conviction takes place, when her license is restored she will have to pay the DMV an additional $250 a year for three (3) years for the Driver Responsibility Assessment fee, mandatory attendance at a Victim Impact Panel Class, and a requirement that she install ignition interlock device in any motor vehicle owns for no less than 6 months.
