Q. Are the terms "Personal Property" and "Separate Property" one in the same?
A: No. “Personal property” refers to the character of the property, specifically ordinary possessions. This is as opposed to real property, intellectual property, registered vehicles, etc. “Separate property” refers to ownership, meaning it is that person’s property and no one else’s. As opposed to community property, which is shared and owned by both parties in a marriage.
Q. I need to have translation of the Estate of Heggstad (1993), 16 Cal. App.4th 943
A: Do you mean you need an attorney to file a Heggstad petition for you? Or you want an explanation of the case? I don’t understand your question.
Q. Is it better to choose an estate lawyer who is located in or near the county where parent died?
A: Yes. It will be helpful to hire an attorney who routinely files probate matters in that county’s court and is familiar with the local rules for that county.
