Legal Answers
4 Questions Answered
Q. I have two speeding tickets in OH in 2 weeks and just got a traffic camera showing I sped through a red. What do I do
A: I would recommend speaking with an Ohio traffic attorney regarding the details of your traffic offenses. The possible penalties will depend on your traffic record leading up these most recent citations.

Generally, a speeding ticket in Ohio generally carries two or four points, depending on how much over the limit you were speeding. In Ohio, you are permitted up to twelve points on your record within a two year period. Once you reach 12 points, your driver's license will be suspended. Talking to an Ohio traffic attorney will help you to determine your options given your driving record and specific facts in your case.
Q. If someone gets ticketed in Ohio and needs legal representation, does the lawyer need to be from Ohio?
A: Yes. Lawyers are regulated and licensed on a state by state basis. In order to practice law in the State of Ohio, the lawyer must be licensed in the State of Ohio (having either taken the bar exam in Ohio or filed the required paperwork to waive in from another state with reciprocity). Unless the out-of-state lawyer is a member of the Ohio bar, he or she generally cannot practice law or represent clients in court in the Ohio.
Q. If the road is iced over and you slide, is it failure to control?
A: Ohio's failure to control statute states that "no person shall operate a motor vehicle . . . without being in reasonable control of the vehicle." Failure to control is generally a minor misdemeanor in Ohio carrying two to four points on your record, depending on whether you were in an accident. As far as whether you would be charged with failure to control if you slid on a icy road, it will depend on the circumstances. If you have been cited, you should consider speaking with an Ohio traffic lawyer regarding your case to discuss your options.
